As hopefully you will be purchasing a merrymurder from this site in some form, we have to have some legal bits.  So please take a look at my solicitor's handiwork below so that you know what your rights and responsibilities are!

THESE TERMS AND CONDITIONS REFER TO YOUR USE OF THE MERRYMURDER WEBSITE. PLEASE READ THEM CAREFULLY BEFORE PROCEEDING FURTHER AS YOUR USE OF THIS SITE SHALL BE DEEMED TO BE AGREEMENT BY YOU TO ALL THE TERMS AND CONDITIONS SET OUT BELOW.

PRICING
We reserve the right to change our pricing policy at any time without notice for all new business. You will not be able to proceed with ordering a Game until you have acknowledged that you have read and understood these Terms and Conditions and paid the price for the Game.

We cannot offer you a refund in the event of any temporary suspension of our service.

Under no circumstances will the liability of merrymurder amount to more than the price paid for the service. Your statutory rights are not affected.

In the event that we are unable to send you your Game in the form of electronic files, we reserve the right to send you a printed copy of the Game and you should allow 14 days for delivery. This will be deemed to be fulfilment of your order. No additional payment will be required from you.

We reserve the right to reject any order or payment entirely at our own discretion.

USE OF THE SITE
The information provided by you is complete and accurate and relates to you personally and not to any other person living, dead or imagined. We reserve the right to terminate your access to the site immediately and without refund if we have grounds to believe that there has been a breach of this condition.

However, we are under no obligation to check the accuracy of your personal information supplied to us by you.

In return for the payment of the price for your Game we grant you a licence to copy and use the Game for personal use and subject to the following conditions:-

1. The Licence granted is for one use only and a further payment for a multiple Licence must be made if you wish to re-use the Game supplied.
2. You will make no charge to others for participating in the Game or to spectators.
3. The Game may be used to raise money for Charity on condition that our name merrymurder.com and the website address and an acknowledgment that the Copyright in the Game belongs to us is displayed clearly on all advertising and marketing copy.

All intellectual property rights are reserved by us including but not limited to all text appearing on the website, or graphics and web page design and any copying or use otherwise than as permitted under the licence granted to you is strictly prohibited without our express written consent. In particular, you will not alter, re-use, copy or in any other way interfere or jeopardise the integrity of the material contained in the Games.

LIMITS OF USE
You agree as a condition of your use of the Game that you will not use the Game for any purpose that is illegal or prohibited by these terms and conditions and in particular without limiting the generality of this obligation not to:-

1. send to us messages containing viruses or other programmes designed to disrupt, destroy or interfere with any software or hardware with which they may come in contact.
2. seek to access personal information of other accounts and users of merrymurder.com including credit card information.
3. Undertake to observe the terms of your Licence to use the Game and indemnify us against any and all costs, claims and liabilities arising from any breach of your Licence. You agree to accept sole responsibility for the proper use and conduct of the Game and the health and welfare of the participants and no liability is accepted by us for any accident or injury arising before during or after the Game has been played.

NOTE that in the event of any criminal misuse of the Game and notwithstanding our Privacy Policy we will co-operate with law enforcement agencies as required by law.

COPYING
Copying of details and information on this site is only permitted with our consent. Consent is not/is required before creating any link to this website from any other website for legitimate commercial purposes which do not represent merrymurder in a false, misleading or offensive manner.

POSTAL DELIVERY
If you opt for delivery of your Game by post, please allow 14 days for delivery. In the event that you have not received your Game within 14 days, please send an e-mail to tim@merrymurder.com.

ACCEPTANCE OF GAME
You should check the contents of the Game as soon as you receive this either by electronic files or by postal delivery. You will be deemed to have accepted that the Game is complete and ready for use unless we receive an e-mail from you within 48 hours of delivery to tim@merrymurder.com. Please note that for postal deliveries this will be 16 days after you have placed your order, allowing for 14 days for delivery of the Game to you.

WEBSITE LINKS
Our website may contain links to other websites over which we have no control and we cannot be held liable in any respect for their content and the existence of a link to another website does not mean that we recommend or endorse the products or services of that website. These links are provided for your convenience and information.

LIMIT OF LIABILITY
Our liability for any loss, damage or inconvenience arising due to our negligence is limited to the price paid for the service.

We can accept no liability for any loss or damage, whether direct indirect or consequential suffered by you as a result of your use of the site or for information on this website or any websites linked to it. Nor for any temporary suspension of the services on this website or otherwise provided by us.

Any information on this website is provided for your convenience and should not be considered specific advice and no liability will be accepted for any loss arising from the use of this information.

We use our best endeavours to ensure that our website facilities are available at all times, but no guarantee can be given. From time to time, the website service will be suspended for necessary maintenance work and this may be required without notice. On these rare occasions we will use our best endeavours to resume service as swiftly as possible.

Whilst we employ extensive firewall virus protection, no liability whatsoever will be accepted for any virus transmitted through the site and you confirm that you will employ proper firewall protection to safeguard against any inadvertent virus infection.

LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of England and Wales and the English Courts shall have sole jurisdiction in respect of them.
